Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Alma Placer Mine; DMG File No. M-1985-029; Preliminary Adequacy Review <br />for Amendment-04 <br />Deaz Mr. Ducommun: <br />The Division of Minerals and Geology has completed its preliminary adequacy review of <br />your 112-construction materials reclamation permit amendment application. The <br />application was received on September 3, 2003 and called complete for review on <br />January 9, 2004. The original decision date for this application was Apri18, 2004, <br />however, since publication as required by Rule 1.6.2(1)(d) was not initiated within 10 <br />days of being called complete, the decision date is being extended by the Division <br />until May 31, 2004 per rule 1.4.1(13). In addition, since we have received an objection <br />to this application, this will allow the item to appeaz before the Mined Land Reclamation <br />Board as required by Rule 1.4.9(2)(a). <br />Please be advised that if you aze unable to satisfactorily address any concerns identified <br />in this review before the decision date, it will be your responsibility to request an <br />extension of the review period. If there aze outstanding issues that have not been <br />adequately addressed prior to the end of the review period, and no extension has been <br />requested, the Division will deny this application. <br />The review consisted of comparing the application content with specific requirements of <br />Rule 6.4 and 6.5 of the Minerals Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for the Extraction of Construction Materials. Any inadequacies are <br />identified under the respective exhibit heading along with suggested actions to correct <br />them. The application, as submitted, was very comprehensive and substantially <br />complete. In addition the application was generally adequate with respect to meeting the <br />requirements of the Mined Land Reclamation Act, however, there are a few items that <br />will require additional information or submittals. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS -REGULAR 112 OPERATIONS <br />6.4.1 EXHIBIT A -Legal Descriation <br />The legal description is adequate as submitted. <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geolo¢ical Survev <br />
