Deaz Mr. Ducommun:
The Division of Minerals and Geology has completed its preliminary adequacy review of
your 112-construction materials reclamation permit amendment application. The
application was received on September 3, 2003 and called complete for review on
January 9, 2004. The original decision date for this application was Apri18, 2004,
however, since publication as required by Rule 1.6.2(1)(d) was not initiated within 10
days of being called complete, the decision date is being extended by the Division
until May 31, 2004 per rule 1.4.1(13). In addition, since we have received an objection
to this application, this will allow the item to appeaz before the Mined Land Reclamation
Board as required by Rule 1.4.9(2)(a).
Please be advised that if you aze unable to satisfactorily address any concerns identified
in this review before the decision date, it will be your responsibility to request an
extension of the review period. If there aze outstanding issues that have not been
adequately addressed prior to the end of the review period, and no extension has been
requested, the Division will deny this application.
The review consisted of comparing the application content with specific requirements of
Rule 6.4 and 6.5 of the Minerals Rules and Regulations of the Colorado Mined Land
Reclamation Board for the Extraction of Construction Materials. Any inadequacies are
identified under the respective exhibit heading along with suggested actions to correct
them. The application, as submitted, was very comprehensive and substantially
complete. In addition the application was generally adequate with respect to meeting the
requirements of the Mined Land Reclamation Act, however, there are a few items that
will require additional information or submittals.
