Dept. are,~RFCLA14iArra-V <br />~' Q~Of1IC@g <br />Re: Notice of Violation No. C-86-033, dated April 23, <br />1986; Trapper Mining Inc. <br />Dear Mike: <br />In accordance with Rule 5.04.3(1), we are submitting <br />the following information on behalf of Trapper Mining Inc. <br />("Trapper") with regard to the referenced NOV. In summary, <br />Trapper believes that no civil penalty should be proposed or <br />assessed for this NOV. An assessment in this case is not <br />mandatory under Rule 5.04.5(1). Trapper has not received any <br />other NOVs or cessation orders within the last twelve months, <br />no assessment for seriousness is appropriate, and any <br />assessment for fault should be low. In any event, credit due <br />for good faith should more than offset any assessment in the <br />other categories. Finally, Trapper believes that vacation of <br />the NOV is appropriate on the grounds that no violation <br />occurred. <br />1. Histor <br />With regard to history, Trapper has not been issued <br />any enforcement actions within twelve months prior to April 23, <br />1986. The last such action was NOV C-85-026 on March 21, 1985, <br />which was vacated on May 9, 1985, after an assessment <br />conference. <br />
