No further work is
necessary. Native American Religious Concems, Threatened and Endangered Species, and analysis of water
depletions for endangered fish were adequately covered in EA CO-034-U-96-35 and EA CO-150-2004-029 DNA,
and water use under this proposal would not exceed that for which a depletion payment was made under the existing
NEPA documents. There are no additional concems relative to impacts on endangered, threatened, or candidate
species.
This drilling project shall be subject to the terms, conditions and stipulations of Coal Lease COC61209, and
requirement of CDMG Permit C-96-083.
Please send us an update of the reclamation bond amount held by the State.
If you have any questions please contact me at 970-240-5302.
Sincerely,
Desty Dyer, BLM~IVI~ ing Engineer
