As requested, 1've reviewed the Energy Mine No. 3 permit for compliance with the following
Colorado Regulations: 2.03.4, 2.03.6, 2.04.5, and 2.04.6.
Rule 2.03.4(1): The permit is in compliance with this rule. It is stated on page 2.03-15
that the applicant is a corporation.
2. Rule 2.03.4(2): The permit is incompliance with this rule. The information required by
this rule may be found on pages 2.03-15 and 2.03-16.
3. Rule 2.03.4(3): The permit (Exhibit 27) identifies the following persons as owners and
controllers of Colorado Yampa Coal Company;
(a) Colorado Yampa Coal Company, and its officers;
(b) Cyprus Yampa Valley Coal Corporation, and its officers;
(c) Cyprus Western Coal Company, and its officers;
(d) Cyprus Amax Coal Holding Company, and its officers;
(e) Cyprus Amax Coal Company, and its officers;
(f) Amax Energy, Inc., and its officers; and
