Renner, Coal Program Supervisor/ <br />RE: Patterns of Violation, Show Cause Order and Bond Forfeiture, Trinidad Basin Mining <br />Company, Trinidad Basin Mine, Permit No. C-81-048 <br />The Division has determined that a Pattern of Violations as defined in Rule 5.03.3121(al has occurred at the <br />Trinidad Basin Mine in Las Animas County. Seven Notices of Violation have been issued to Trinidad Basin <br />Mining Company within the last twelve months. All have either been upheld in Assessment Conferences or <br />have not been contested by the operator. <br />All seven violations were issued during two separate inspections that occurred in June and July of 1992. <br />Six of the violations cited non-compliance of the Performance Standards pertaining to protection of water <br />quality and maintenance of hydrologic structures. <br />The seven Notices of Violation are: <br />1 . NOV C-92-013 (June 29, 1992 inspection) issued on July 16, 1992 for failure to maintain <br />sediment pond 15-P7. The discharge was out of compliance with NPDES standards. The rules <br />cited were 4.05.2171, 4.05.2181 and 4.05.61311a1 and Ibl. The abatement was to excavate <br />sediment from the pond and recertify. The abatement deadline dates were extended several times <br />due to bad weather. The abatement work has yet to be started. <br />2. NOV C-92-014 (June 29, 1992 inspection) issued July 16, 1992 for allowing surface water runoff <br />from a disturbed area discharging offsite without treatment. The rules cited were 4.05.2(1) and <br />4.05.2(21. The abatement was to reestablish a ditch. The abatement work was completed on <br />time without extensions and the NOV was terminated. <br />3. NOV C-92-020 (July 28, 1992 inspection) issued August 14, 1992 for failure to maintain the <br />primary dewatering devices for sediment ponds 15-P10, 15-P11 and 15-P12. The rules cited were <br />4.05.61311a1 and Icl. The abatement work was to unclog primary spillways and install trash <br />guards. The abatement deadline dates were extended several times due to bad weather. The <br />primary spillways were unclogged within the first abatement deadline but work on the trash guards <br />has not been completed. <br />4. NOV C-92-021 (July 28, 1992 inspection) issued on August 14, 1992 for failure to maintain the <br />principal spillways of permanent impoundments 15-P1, 15-P2, 15-P8, 15-P20 and 22-P17. The <br />rule cited was 4.05.91111e1. The abatement work was to unclog the primary spillways and install <br />trash guards. There have been several extensions of the abatement deadline dates. The primary <br />spillways were unclogged within the first abatement deadline, but not all of the trash guards have <br />been installed yet. <br />
