NOTICE OF FILING APPLICATION <br />FOR COLORADO MINED LAND RECLAMATION PERMIT AMENDMENT (AM-OS) <br />FOR REGULAR (112D) DESIGNATED MINING OPERATION <br />Notice to the County Board of County Commissioners <br />Eagle County <br />The Climax Molybdenum Company, Climax Mine (Climax) (Highway 91, Fremont Pass, <br />Climax, Colorado 80429; 719-486-2150) will submit an application with the Colorado <br />Mined Land Reclamation Board (MLRB) for an amendment (AM-05) to its current <br />Mining and Reclamation Permit (M-1977-493) for its site located on and about Fremont <br />Pass within Summit County, Lake County, and Eagle County. The enclosed information <br />is being provided to notify you of the location and nature of the proposed activities <br />included in the action. The entire application will be on file with the Colorado Division of <br />Minerals and Geology (Division) and with the Eagle, Lake, and Summit County Clerk <br />and Recorder at the time of its submittal to the Colorado Division of Minerals and <br />Geology (DMG). <br />The Amendment proposes two changes to the Climax Mine Reclamation Permit. The <br />first clarifies the operational status of the Climax Mine in light of evolving global markets <br />for molybdenum and the business context in which the Climax Molybdenum Company <br />will operate the Climax Mine as it manages molybdenite reserves at the Henderson and <br />Climax Mines in Colorado. This Amendment revises the Mining Plan and provides an <br />explanation of CMC's basis for resumption of operations at Climax. <br />In the second change, Climax proposes to construct and operate new facilities to <br />produce high-density sludge from the existing water treatment system. This facility will <br />be located within the affected land area adjacent to the present lime plant. Sludge will <br />disposed within containment cells located within the existing Tenmile Tailing <br />Impoundment. The existing CDPES permit to discharge treated water into Tenmile <br />Creek will not change, although improvements in water quality are anticipated. The <br />sludge facility is considered an upgrade to the present water treatment system at the <br />Climax Mine. This action will not increase the permitted affected land area or mining or <br />milling activities at the site. Likewise, the action will not affect the financial warranty for <br />reclamation. Proposed commencement of construction of the high-density sludge <br />facility is in May, 2006 with an expected completion/commissioning date in November <br />2007. <br />Post-mining land use at the Climax site remains unchanged, and consists of Rangeland, <br />Developed Water Resources, Recreation, and Industrial/Commercial as per the existing <br />Reclamation Plan. Pursuant to Section 34-32-116 (7)(j), CRS, the MLRB is required to <br />confer with the local Board of County Commissioners before approval. Accordingly, the <br />MLRB would appreciate your comments on the proposed action.
