This is a mining plan modification <br />for a surface mine being permitted under the Federal lands <br />program and the approved Colorado State program and cooperative <br />agreement. My recommendation to approve the Colowyo Mine mining <br />plan modification is based on: (1) Colowyo Coal Company's <br />(Colowyo's) complete permit application package (PAP), (2) <br />compliance with the National Environmental Policy Act of 1969, <br />(3) documentation assuring compliance with applicable <br />requirements of other Federal laws, regulations, and executive <br />orders, (4) Comments and recommendations or concurrence of other <br />Federal agencies, and the public, (5) the findings and <br />recommendations of the Bureau of Land Management (BEM) with <br />respect to the resource recovery and protection plan and other <br />requirements of the Federal lease and the Mineral Leasing Act, <br />and (6) review of the PAP by the Colorado Mined Land Reclamation <br />Division (NERD) as required by the Colorado State program and <br />cooperative agreement. <br />Approval of this modification will authorize mining of about 9 <br />million additional tons of Federal coal and will add about 497 <br />acres in Federal lease C-29224 to the approved mining plan <br />approval area, as shown on the map included with this decision <br />document. The review of the PAP indicated that Colowyo's <br />proposal would not require special conditions to be included in <br />the mining plan approval document to comply with Federal law. <br />Colorado MLRD reviewed the permit revision application under the <br />Colorado State program, the Federal lands program (30 CFR <br />Chapter VII, Subchapter D), and the Colorado cooperative <br />
