MANAGEMENT <br />~~~~ <br />a~ '?~ <br />+'~., _ <br /> <br />The referenced NOV was written on December 21, 2001 for failure to complete the interim <br />reclamation at the Munger Mine bench as contemporaneously as practicable. The violation will be <br />abated after the coal material located at the Munger Mine bench is covered with non-toxic soil and <br />reseeded with the approved stabilization seed mix. The abatement deadline is March 21, 2002. <br />On behalf of Lodestar Energy, Inc., and in accordance with Rule 5.03.2(c)(i), please extend the <br />abatement deadline until April 21, 2002. <br />Rule 5.03.2(c)(iv) provides for the extension of an abatement period of more than 90 days where <br />climatic conditions preclude abatement within 90 days or where, due to climatic conditions, <br />abatement within 90 days clearly would cause more environmental harm than it would prevent. The <br />work remaining is to cover the compacted coal material with non-toxic soil, The work has not been <br />completed within the 90 day abatement period because of climatic conditions. Access to the Mine <br />bench is problematic during some winter months. The mine site at Lodestar's nearby McClave <br />Canyon Mine has been snow covered, frozen or a muddy mess this winter with conditions expected <br />to be slightly worse at the Munger Mine bench because it is slightly higher in elevation and is on <br />a north facing slope. These winter weather conditions are not suitable for covering the coal <br />material with non-toxic cover. <br />Lodestar has mobilized a track dozer to its McClave Canyon Mine to perform the abatement step <br />as soon as weather conditions permit. A week of relatively dry weather is considered necessary <br />before the work should begin. The compacted coal material is within an area that has <br />sedimentation control so delaying the project should not be an environmental concern. Lodestar <br />is committed to performing the work necessary to abate the NOV as soon as weather permits. <br />Please let me know if you have any questions. <br />Sir~~el /y~ <br />JJf E.
