Box 591
Somerset, CO 81434
RE: West Elk Mine (C-80-007); NOV CV-99-005
Dear Mr. Schmidt:
We received your letter dated July 13, 1999 regarding NOV CV-99-005. In your
letter, you discuss three points of contention with statements in the Division's
proposed civil penalty assessment for the NOV. You asked that those points be
corrected.
The proposed civil penalty may be modified as a result of an informal
assessment. However, I cannot modify the assessment. Your letter will be
placed in the NOV file so your comments are on record. We will review the
revised SAE demonstrations as soon as possible following its submittal. Once
that is approved, the NOV will be terminated...
If you have arty questions, please contact me.
Sincerely,
Larry Routten
Senior Environmental Protection Specialist
DIVISION OF
MINERALS
GEOLOGY
REC IA MATION
MINING•SAFE TY
B~II ovens
Governor
Greg E. bValcher
E~ecuhve Director
nLChael B.
