i r
the substitute supply plan, or a letter from the State Engineers
Office that indicates that all water rights concerns have been
satisfied.
Another remaining concern regarding the Airport No. 3 Pit amendment
application is the matter of a cultural resource survey of the
permit area. The State Historic Preservation Officer has indicated
that under the auspices of the Colorado Register of Historic Places
Act, a survey of all undisturbed portions of the mine site,
including those portions currently under permit as well as
undisturbed lands to be added through amendment, would be required.
In general, the Minerals Proqram within the Division of Minerals
and Geology requires mine operators to provide documentation from
the State Historic Preservation Office that all concerns under
their jurisdiction have been satisfied. If such documentation has
not been received by the permit or amendment decision date, the
Division will place a stipulation on approval that no undisturbed
ground be affected until clearance is received from the State
Historic Preservation Office. A determination as to the wording
and requirements of any such stipulation that may be placed on
approval of the Airport No. 3 Pit amendment will be made prior to
the decision date, pending a review of internal policy and possibly
input from the Attorney Generals Office.
If you have any questions, please contact me.
Sincerely,
• ~i
Al en C.
