C-85-040, C-85-041, and C-85-044 <br />Dear Mr. Mathews: <br />I would like to express my appreciation for your taking time to meet with <br />me on January 3 to discuss the above alleged violations. I believe the <br />meeting was very fruitful in furthering our respective understandings of the <br />alleged NOV's and the reasons for issuing them. Also, the discussion <br />concerning the permit and it's interpretation problems proved beneficial as <br />future revisions can be drafted which should decrease the potential of those <br />types of problems from recurring. <br />Attached you will find information detailing the topsoiling and <br />reclamation activities far the period of September 1, 1984, through <br />November 15, 1984, and the precipitation records for the period of August 31, <br />1984, through November 30, 1984. The schedu]e of the topsoiling and <br />reclamation activities demonstrates that CYCC was attempting to complete the <br />required reclamation work during the appropriate season. From the work <br />records for May, 1985, it is seen that it took approximately three (3) days to <br />complete the contour furrowing at Mine 3. If this is compared with the three <br />days lost to weather (snowed-out) during 1984, it is safe to assume that the <br />contour furrowing could have been completed at Mine 3. Given the set of <br />circumstances, it is requested that alleged NOV C-85-044 be vacated. <br />In reference to the alleged NOV C-85-040, it is requested that you review <br />the information presented in Mr. Rick Hughes letter of June 7, 1985, to <br />yourself. I believe sufficient information is contained within that letter to <br />justify vacation of this alleged NOV. <br />I believe, after you give serious consideration to the information <br />presented above and in the attachments, you will concur with CYCC that <br />adequate information exists to suggest that these alleged violations should be <br />vacated. <br />Z <br />
