Long
Division DireUOr
We have received and considered the materials submitted October 18, 1993, regarding the
Notice of Violation No. C-93-112. It appears that the surface owner entities in question did
receive proper notification during 1984 and 1985. Based upon the letters received from the
landowners, and based upon the provided mining schedule information and affidavit, I hereby
vacate Notice of Violation C-93-112.
Please be aware that all surface owner entities, including public agencies such as the Forest
Service, are entitled to the notice specified at Rule 4.20.2. The violation is vacated, in part,
because the landowners involved have verified that they were adequately noticed. Please be
sure that all future mining activities are preceded by the required landowner notification, and
that all such notices are both timely and in compliance with the content requirements.
Thank you for gathering the referenced materials for my review.
Sincerely,
Michael B.
