Long <br />Division DireUOr <br />We have received and considered the materials submitted October 18, 1993, regarding the <br />Notice of Violation No. C-93-112. It appears that the surface owner entities in question did <br />receive proper notification during 1984 and 1985. Based upon the letters received from the <br />landowners, and based upon the provided mining schedule information and affidavit, I hereby <br />vacate Notice of Violation C-93-112. <br />Please be aware that all surface owner entities, including public agencies such as the Forest <br />Service, are entitled to the notice specified at Rule 4.20.2. The violation is vacated, in part, <br />because the landowners involved have verified that they were adequately noticed. Please be <br />sure that all future mining activities are preceded by the required landowner notification, and <br />that all such notices are both timely and in compliance with the content requirements. <br />Thank you for gathering the referenced materials for my review. <br />Sincerely, <br />Michael B.
