© MONTGOMERY WATSON <br />Mining Group <br />October 25, 2000 <br />Mr. Tom Kaldenbach <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: H-G Coal Company <br />Hayden Gulch Mine; Permit G80-003 <br />Notice of Violation No. CV-2000-008 <br />Dear Mr. Kaldenbach: <br />iii iuiiiiiiiiii iii <br />(Via: Fax and Certified Mail) <br />No. Z 439 401 661 <br />iiECEIVED <br />OCT 26 2000 <br />?ivision of Minerals & Geolon/ <br />The H-G Coal Company (HGCI~ is hereby submitting written information to the Colorado <br />Division of Minerals and Geology (CDMG) regarding the above referenced notice of violation in <br />accordance with Section 5.04.3(1) of the Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Muting. <br />The CDMG issued Notice of Violation No. CV-2000-008 on October 10, 2000. This notice was <br />issued because HGCC did not have a current, valid insurance certificate in the public files during <br />CDMG's third quarter complete inspection. The insurance certificate expired on June 30, 2000. <br />The third quarter complete inspection was conducted on September 20, 2000. HGCC's local <br />representative has no recollection of the CDMG's inspector noting that the certificate was expired <br />during the records check portion of the inspection. HGCC's representative believes that the first <br />time the expired certificate was brought to his attention was on or about September 27, 2000. At <br />that time, Mr. John Weinman of Montgomery Watson, HGCC's local representative, contacted <br />Marsh 1JSA, Inc., the issuer of the certificate, about getting a new certificate. <br />Mr. Weinman again contacted Marsh on October 2, 2000, via facsimile, requesting a new certificate <br />with instructions on how the cancellation notice needed to be revised. On or about Ctctober 4, <br />2000, Mr. Weinman was notified that the CDMG needed to have the certificate in their office by <br />12:00 noon on October 6, 2000. Mr. Weinman intrttediately made several phone calls to Marsh, <br />and to our corporate insurance office requesting immediate assistance with the mater. <br />The CDMG's notice of violation, and third quarter inspection report were received by Mr. <br />Weinman via facsimile at approximately 12:48 p.m on October 10, 2000. Mr. Weinmitt received a <br />facsimile copy of a current, valid insurance certificate from Marsh on October 10, 2000. He <br />forwarded a copyto CDMG at approximately 14:01 p.m Mr. Weinman called Mr. Kaldenbach at <br />approximately 14:05 to notify him that a copy of the current, valid certificate had been sent to <br />CDMG via facsimile. During their phone conversation Mr. Kaldenbach informed Mr. Weirurun <br />that the CDMG had issued the notice of violation. Mr. Weintrtan ako notified Mr. Kaldenbach <br />that this certificate did not have the required cancellation notation, and that he would have Marsh <br />revise the certificate with the proper notation.
