Issues related to a diesel fuel release that occurred on the mine property in 2001 <br />were addressed in TR-003. That revision contained statements prepared by Scott Rutherford, Paragon <br />Consulting Group, that soil abatement activity beyond that which had already been completed was not <br />warranted, however the parameters of TR-003 anticipated additional extraction activity adjacent to the <br />abatement area which would provide for excavation of any remaining contaminated soil. <br />Extraction activity at the 83'~ Joint Venture site was recently completed without additional mining <br />adjacent to the abatement area because it was determined that aggregate reserves in that area are not <br />economically recoverable. As Paragon's original assessment and further evaluation indicate that the <br />Division's groundwater quality goals have been achieved for this site without the necessity of additional <br />extraction adjacent to the abatement area, Aggregate Industries requests release from any requirement to <br />excavate in accordance with TR-003 and that the site be released from further assessment or abatement <br />activity related to the matter of the 2001 fuel release. Paragon's additional evaluation of the potential <br />effect of the remaining soil contamination on goundwater quality, originally submitted to the Division on <br />March 11, 2003, is resubmitted herewith in support of this request. <br />We appreciate your consideration of this technical revision request.
