Long <br />Division Director <br />I have completed my final review of the amendment application for the Tezak <br />Aggregate Source quarry. Review comments 1, 4, 5, and 6, as lic:ted in my <br />July 17, 1995 adequacy letter, still require clarification and/or :_esolution. <br />Therefore, i suggest that you submit a response to these items no later than <br />September 29, 1995. <br />My concern for items 1, 4, and 5 remain the same. My concern for item 6 is that the <br />operator is able to demonstrate that the primary collection ditches are constructed <br />to withstand the peak flow velocity (fps) expected from a 10-year 24-hour storm and <br />that the operator provide an adequate design for managing stormwater runoff near the <br />entrance to the quarry operation along Tunnel Drive. <br />It is my understanding that Mr. Tezak has chosen to follow Option I, as r>utlined in <br />my August 2, 1995 letter, and to proceed with the application "as is." <br />Accordingly, the Division should be able to make a recommendation on th=_ <br />application by October 3, 1995. <br />A pre-hearing conference will be held in Canon City during the week of October 11, <br />1995. I will inform you of the date and time of the pre-hearing conference <br />following the September 27-28 Board Meeting. Finally, a Formal Public Hr;aring will <br />be held in Denver on October 17-18, 1995 before the Mine Land Reclamation Board to <br />determine the outcome of the application. <br />Please call either me or Jim Stevens at (303) 866-3567, if you have que,ations. <br />Sincerely, <br />r~0 <br />Thomas A.
