~ Both part lee have specific and separate statutory reeponeibilitiee to review permit
applications, monitor and inspect field sites, and take enforcement action. The
parties exercise of their respective reeponeibilities has the potential for
duplication and inconeietent actions by the parties in the management of hydrologic
balance and water quality issues with respect to the reeponeibllitiea. This MOU
addressee each area of responsibility separately.
Review of Permit Aoplicationa
The parties will coordinate the review of hydrologic information submitted within
a coal mining permit application with respect to information relevant to Colorado
Discharge Permit System (COPS) permits for process/mine water and etormwater point
source discharges. The coordination will entail the following:
1. During pre-application meetings with potential coal mine permit applicants,
each party will advise the applicant of the need to contact the other party.
2. DMC will review the coal permit applications to determine whether the
sediment control structures will be designed to meet technology based
effluent limitations and That any stormwater control technologies are in
conformance with the Rules and Regulations for Coal Mining, CRS 3d-33-101.
3. The parties will confer, ae appropriate, during the course of permit review
and drafting to coordinate where there may be duplication or potential
conflict, and to keep each party apprised of technical developments.
4. WQCD will provide DMG with copies of all final COPS permits actions for coal
mines, at the time of action issuance. Conversely, DMG will provide WQCD
copies of all notices of final action on coal mining permits.
~. Trainino
WQCD will provide water quality sample collection training to DMG staff upon the
request of DHG. Each party will also provide general inspection training upon the
request of the other party.
Inspections, Monitorino and Sample Analveis
The parties will coordinate inspections, monitoring and sample analysis in the
following manner:
1. In those instances where effluent violations are suspected, DHG shall collect
water quality samples at COPS discharge points 'during the course of
conducting its normal site inspection obligations. In those instances where
DHG suspects an unpezmitted diecharkje, DHG shall collect a water quality
sample for analysis.
2. DMC shall include in its inspection reports which accompany a sample result
specified in item 1 of this section a detailed description of site conditions
and a discussion as to whether a precipitation event has occurred at the site
within the preceding 24 hours..
3. To the extent funds allow, W4CD shall pay for the cost of analysis for
samples collected pursuant to item 1 of this section. Such samples are to be
delivered to the Laboratory Division of the Colorado Department of Health for
analysis. DMC shall absorb the coat of obtaining the samples and
transmitting them to the lab.
9. Sample collection by DMG shall follow all chain-of-custody and other normal
enforcement procedures to ensure sample integrity.
