(Page 2) MIND ID N OR PROSPECTING ID # M-99-091 INSPECTION DATE 1/8/99 ?NSPECTOP.'S INITIALS AJW OBSERVATIONS This was a pre-operational inspection conducted as a result of disturbance occurring at this location prior to obtaining a fully approved reclamation permit. The disturbance was observed by this inspector while conducting another inspection in the general area. It was noted that a sign had been posted indicating that a 110 construction materials reclamtion permit application had been submitted to this office. It ~Nas also noted that some disturbance was occuring at this site. In addition, upon returning to the office, it was verified that an application had been submitted for this site but had been called incomplete. None of the missing information to complete. the application had been submitted as of this inspection. The site is located approximately 6 miles southeast of Buena Vista, Colorado in the active channel of lower Arnold Gulch. The permit area is located where the Arnold Gulch canyon opens up into a depositional flood plain and has historically been mined for sand and gravel fill. The permit area is a series of 1 acre retangular blocks joined together in a slightly winding retangular shape fully encompassing a section of the active channel of the gulch. By looking at the site it is obvious that the area has been historically mined for many years. Just upstream of the recent disturbance is an area that was obviously disturbed and is now overgrown with vegetation consisting mostly of annual weeds. The active disturbance butts up against this area and covers approximately 1-2 acres fully contained in the first two blocks of the proposed permit area and has been mined to a depth of approximately 20 feet. The south side of the proposed permit area has been delineated with tee-posts every 209 feet to identify the proposed blocks. The operator was informed that a cease and desist order would be issued from the office and that they would be required to appear before the Mined Land Reclamation Board. The operator requested in writing to waive their right to 30 days notice prior to the hearing and wishes to appear before the Board in January if possible. In addition, since the application has not been approved, this is being cited as a possible violation on page three of this report along with the appropriate corrective action, which is to: Submit the missing information which will make the application complete and ready for technical review and; Follow-up with any requested submittals so that the application can be approved as soon as possible. A "Reason to Believe that a Violation Exists Letter" will also be sent to the operator explaining the natuze of the violation and when the Board Hearing will be held.
