<br /> <br />CIVIL PENALTY (C.R.S. 34-325-123(2) and (4) MINING WI'f ROUT A PERMIT <br />I. Require the operator and/or landowner to pay a minimum civil penalty: <br />[n the amount of $ 4.5.16 ,based on 13 hours to stafF time at $37.93/hour. <br />2. [f the Board Finds the operation to be an i1le~al Construction Material Extraction Operation, the <br />Board should also assess the operator and/or landowner a civil penalty of no[ less than $1,000.00 per <br />day nor more than $x,000.00 per day for each day the land has been affected, not to exceed 36~ <br />days. <br />In this case, the Office recommends that the Board could End 19 days <br />of violation at $1,000.00 to 5,000.00 per day. <br />3.
