Tejon, Suite 800 <br />Colorado Springs, Colorado 80903 <br />Mr. Larry King <br />U.S. Steel Mining Co., Inc. <br />600 Grant Street <br />Pittsburgh, Pennsylvania 15230 <br />Re: Somerset M//i/ne, Permit No. C-81-022 <br />Dear Gei~m~~ <br />On February 27, 1987 Tom Schreiner and I met with Larry King and <br />David Onuscheck, representatives of U.S. Steel, to discuss the status of the <br />Somerset Mine in Somerset, Colorado. We met with Dan Hadley and Jeff Collins, <br />representatives of Kaiser Coal Co., on March 24, 1987 to discuss similar <br />issues. At the conclusion of each meeting I told the parties we would send a <br />letter to each identifying the status of the issues pertaining to the permit <br />and the mine site. This letter conveys that information. <br />General Status <br />During 1986 three actions pertaining to the Somerset Mine permit took place. <br />The first was the initiation of the transfer of permit from U.S. Steel to <br />Kaiser Coal Company. The second was the required review of the adequacy of <br />the reclamation bond and the third was the mid-term review of the permit. <br />The Division has not transferred the permit from U. S. Steel to Kaiser Coal <br />Co. The transfer has been delayed over the past year because Kaiser Coal Co., <br />had to resolve issues with the Bureau of Land Management (BLM) regarding right <br />of entry and the Division had not received a properly executed letter of <br />credit from Chase Manhattan Bank. The issues involving BLM have been <br />resolved. The issue pertaining to the letter of credit is still outstanding; <br />therefore, the Division still holds U.S.Steel as the permittee. We recognize <br />this may create problems because Kaiser Coai continues to represent that they <br />are the party managing the mine site. As both parties have expressed a desire <br />to ensure that the property is properly maintained, we will continue to work <br />with Kaiser Coal Co. on the environmental maintenance until we are instructed <br />otherwise. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
