Cottony <br />Acting Division Director <br />On July 18, 2002, the Division of Minerals and Geology conducted an inspection of your operation and found the <br />following: Fremont County is excavating and removing sand and gravel material from an unpermitted area in Section <br />20, T 48N - R 11E, NMPM, Fremont County, about 3 miles north of Coaldale, Colorado. <br />We believe this is in violation of: C.R.S. 34-32.5-109 for Mining Without a Permit. <br />Therefore, we have reason to believe that a violation exists and have scheduled [his matter before the Mined Land <br />Reclamation Boazd. <br />A Formal Public Hearing will be held during the September 18-19, 2002 Boazd meeting for consideration of possible <br />violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denvet, Colorado, beginning at 10:00 a.m. <br />on September 18 and at 9:00 a.m. on September 19. Depending on the day that your hearing is scheduled, this matter <br />will begin at those times or as soon thereafter as the matter can be considered. At that hearing you will have the <br />opportunity to be represented and heard. It will be reiterated that there is reason to believe that you are in violation of <br />the provisions noted above. <br />If the Boazd finds a violation at this hearing, it may issue a Cease and Desist order, require certain corrective actions and <br />assess a Civil Penalty in the amount of $1,000.00 to $5,000.00 for each day of violation.
