Powderhorn may elect to rely upon its March 19, 2001 <br />Petition for Formal Review By the Mined Land Reclamation Board <br />of NOV # CV-2000-010 as its appeal on the merits of NOV # CV- <br />2000-010 and of the March 20, 2001 Modification of NOV # CV- <br />2000-010. In that case, Powderhorn does not need to take any <br />further action in order to perfect its appeal, and DMG shall <br />treat Powderhorn's March 19, 2001 Petition for Formal Review <br />as Powderhorn's appeal brief on the merits with respect to NOV <br /># CV-2000-010 and the March 20, 2001 Modification of NOV # CV- <br />2000-010. <br />At its option, Powderhorn may alternatively elect to file <br />an appeal of NOV # CV-2000-010 and the March 20, 2001 <br />Modification of NOV # CV-2000-010, which is different from its <br />March 19, 2001 Petition for Formal Review. If Powderhorn <br />chooses to modify its March 19, 2001 Petition for Formal <br />Review, it must do so before 5:00 p.m. (Denver time) on April <br />20, 2001, and must serve and file said modified Petition for <br />Formal Review before 5:00 p.m. (Denver time) on April 20, <br />2001. (Electronic or faxed service, followed up by hard copy, <br />is acceptable.) <br />DMG agrees to schedule a hearing on Powderhorn Coal <br />Company's Petition for Formal Review By the Mined Land <br />Reclamation Board of NOV # CV-2000-010 (and of the March 20, <br />2001 Modification of NOV # CV-2000-010) for the Board's May <br />2001 hearing, which is scheduled for May 23 and 24, 2001. <br />If Powderhorn prevails before the Board, it will have no <br />need for temporary relief. If DMG prevails, Powderhorn will be <br />seeking a stay of the Board's order, pending appeal, not <br />temporary relief. <br />Consequently, there is no need for temporary relief or a <br />stay of enforcement, and Powderhorn Coal Company's Request for <br />2 <br />
