Long
Division Director
The Division would like to respond to The Office of Surface Mining Reclamation and
Enforcement's findings that a violation referred to in Ten-Day Notice 95-020-352-001 existed at
the time of the last State complete inspection. The Division contends that the referenced
violation did not exist at the time of the State's last complete inspection, which occurred on
January 27, 1995, because we do not consider that the condition referenced in the Ten-Day
Notice as a violation of any State or Federal Law or Regulation.
Please find the enclosed signed form reiterating the Division's position.
Sincerely,
\,
1~e H, Bi
C Envir nmental Protection Specialist
enclosure
c:\jhb\lsciresp.[dn
