Box 100 <br />Castle Rock, CO 80104 <br />RE: South 40 Quarry (Permit M-90-016) Corrective action for Notice of Violation MV-97-034 <br />and Division's inspection to confirm completion by February 15, 1998. <br />Dear Mr. Wagner: <br />Enclosed is another copy of ]Notice of Violation MV-97-034. As indicated [o you in my Fax of <br />January 20, 1998, the corrective action for MV-97-034 (See Page 3 of the Notice of Violation <br />attached) requires not only the boundaries of the South 40 permit area be mazked but a sketch <br />map of the permiUaffected area be provided after the boundaries have been mazked together with <br />photographs of the markers installed in order to facilitate the Division's subsequent inspections <br />of the site. You indicated in the voice mail message you left me on January 6, 1998 that markers <br />had been installed. You have not, however, supplied the sketch map and photographs. <br />The Division is committed to confirm that the marking of the boundaries of the South 40 Quarry <br />was completed by February 15, ]998 in order that High Plains Stone not be required to pay the <br />remaining $6,100.00 of the total $6,300.00 civil penalty assessed for MV-97-034 (See Page 3 of <br />the Notice of Violation attached). I currently plan to conduct an inspection for that purpose, <br />weather permitting, during the week of February 16, 1998 with or without the sketch map and <br />photographs. <br />As you know, I was unable [o locate boundary markers for the South 40 Quarry during my last <br />two inspections. That is the r•~ason why the sketch map and photographs aze considered <br />important. If, at the time of the February 1998 inspection, I lack the sketch map and photographs <br />of the boundary markers required by the corrective action for MV-97-034 and cannot find the <br />
