Cadany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety has received Mesa County's request for to amend the Reclamation Plan for <br />the above referenced permitted site. A review of the request actually seems to fit the Division's Technical Revision (TR) <br />process more than an amendment (AM). The main issue is whether any work has begun on the site or not. If the proposal is <br />in the planning phase, the County can initiate a TR that addresses the changes to the Reclamation Plan which is consistent <br />with the Post Mined Land Use. If the County has already begun changes to the site such as moving in equipment and <br />structures for a transfer station, then an amendment is necessary to change the Post Mine land use. <br />A TR submittal is consistent with the letter sent August 21", 2006. A fee is required for Technical Revisions in the amount <br />of $188.00. If it appears that a TR is what [he County is seeking a letter clarifying that no changes have been made on site <br />and the fee will start the process. By Rule, once the TR is called complete by the Denver Office, there is a 30 day Decision <br />Date deadline. <br />If Mesa County has already begun changes to the site, like the Kelly Pit, then an amendment to change the Post Mine Land <br />use will be required. The Fee is $719.00 and is treated like a new application. An amendment requires all the proper <br />exhibits, maps, notifications and public notice. <br />The submittal is being called incomplete for lack of the proper fee.
