Lochhead <br />Execwive Direaur <br />hechaclH Lang <br />Division Director <br />RE: Roadside Mine Pattern of Violations <br />Permit No. C-81-041 <br />Dear Mr. McNab: <br />This letter is to inform you that, as a result of the recent issuance of Failure-To-Abate Cessation <br />Order No. CO-98-001 to Powderhorn Coal Company (PCC) for operations at the Roadside North <br />and South Portals Mine, I have conducted a review of the history of violations for the operation, <br />and I have determined that a pattem of violations does exist, pursuant to Rules 5.03.3(5) and <br />5.03.3(2). Enforcement actions considered in the pattem of violations review are summarized <br />below: <br />November 25. 1996 Inspection <br />NOV C-96-020 Failure to ensure that drainage is not directed over the outslope of the fill, <br />and failure to minimize erosion as necessary to provide protection for <br />topsoil, vegetation, and [he hydrologic balance. Refuse Area CRDA #2. <br />January l3, 1997 Inspection <br />NOV C-97-001 Failure to ensure that water discharged from an underground mine <br />complies with all federal and state laws and reeulations. Minewa[er TSS <br />level of 520 mg/I significantly exceeded 40 CFR 434.42 efFluent limit of <br />70 mg/l, l day maximum. Discharge Point 004. <br />October 3. 1997 Inspection <br />NOV C-97-016 Failure to ensure proper surface drainage control on coal waste disposal <br />area, CRDA #1 and CRDA #2 in accordance with performance standards <br />pertaining to diversion of upland flow, drainage over the outslope of the <br />
