SHELTON, Director
P4ay 8, 1987
Mr. Dean Massey, Esa,
Parcel; Mauro, Holtin and Spannstra
3600 City Center 4
1801 California Street
Denver, Colorado 80202
Re: Status of G.E.C. Resolution - Bond Forfeiture
Dear Mr, Massey:
At the October 23 and 24, 1986 meeting of the Mined Land Reclamation Board, a
formal public hearing was initiated to discuss the status of the Board order
that directs G.E.C. to reclaim the G.E,C, mine site and the status of the bond
situation. That formal public hearing has been continued for several months
pending presentation by G.E.C. of acceptable alternatives to the existing
Board order, Among topics that have heen discussed with the Board during
those hearings has been the lack of progress on reclamation at the site, lack
of adeouate bond and the forfeiture of the remaining bond,
More recently the alternative reclamation plan effort has focused upon
development of a three party agreement between G.E.C., the Tandowner,
Dr, Corley, and Energy Fuels Corporation, Communication we have had from the
parties today indicates that the negotiation effort to develop an agreement
has failed.
Given this,.we want to make it clear to you that the Division fu1Ty intends to
recommend at the May 27 and 28, 1987 Board meeting that the Board forfeit the
bonds that the state currently holds for the G.E.C. mine site. From the
Division perspective, this recommendation would be withheld only if a
satisfactory alternative is presented to the Division before the Board meeting,
We regret that this appears to
time, but we felt it necessary
recommend bond forfeiture, If
call Mike Long or myself,
be the only acceptable
to inform you directly
you have any questions
alternative at this
of our intent to
regarding this, please
rel
- G
F d anta
"s r, Coal Program
J
FRB/lal
cc: Steve Layton
Linda White
423 Centennial Building, 1313 Sherman Street Denver, Colorado B0203-2273 Tel.
