<br />Battle Mountain Gold <br />NOPV Abatement Requirements & Status <br />page 8 <br /> <br />BMG, in order to ensure accurate monitoring of water quality, shall <br />complete a comprehensive evaluation of the procedures used for sample <br />collection, preservation, transportation, analysis and reporti g. At a <br />minimum, this evacuation shall include consideration of legal 'chain of <br />custody", prevention of contamination during sampling, preparation and <br />preservation of samples, appropriate transportation of sampiesito the <br />laboratory, "quality assurance/quality control" (QA/QC) method logx <br />within the laboratory, split sampling redundancy and verification of <br />monitoring acruracy. This evaluation, including a detailed sa piing and <br />analysis protocol, shall be submitted to the Division as a tec nical <br />revision no later than Monday, May 4, 1992. <br />MLRB Order: The Board issued the Notice of Violation & Order do May 28, <br />1992. The Order contained the following: <br />"21. BMRI's application for a technical revision s omitted <br />in response to item (12) of the Abatement Requirements, ntitled <br />"Modification of Monit~~ Sampling & Analysis Protocol", shall: <br />comply with all applicable statutes and regulations; <br />b. comply with the requirements specified in item (~12) of <br />the Abatement Requirements; and <br />c. provide for independent sampling and analysis, b a <br />third party at BMRI's expense, at a frequency to be eter- <br />mined by the Mined Land Reclamation Division to veri y <br />pertinent data." <br />Status: BMG verbally committed to comply on April 22, 1992. B G <br />completed the split sample analyses and submitted the results <br />to the Division on April Zl, 1992. The requirements f r the <br />protocol revision were only advanced by the Division o <br />April 21, 1992. <br />Protocol Modification <br />May Progress: - BMG submitted technical revision applicati n TR-006, <br />on May 4, 1992. Copies were provided to t e parties <br />for comment. <br />June Progress: - The Division forwarded its technical comme~ts, <br />including the comments of Dr. Hyatt, repre enting <br />PAES, to BMG for response on June 1, 1992. <br />- June 2, 1992, BMG requested an extension o~F the <br />review deadline until June 17th. <br />- June 12, 1992, BMG submitted responses to the <br />technical adequacy comments. <br />
