NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to Approve Technical Revision Application <br />No. 52 (TR-52) for the Seneca II-W Mine (Permit No. C-1982-057), submitted by Seneca Coal Company. <br />This revision application provides updates to the hydrology monitoring plan, as requested in Items 13, 25, <br />26, and 47 of the Division's December 22, 2003 Mid-term review letter. The revision also addresses <br />failure of the W-24 series wells and installation of the replacement wells (W-25 Series), as well as other <br />minor changes to monitoring plans and analytical pazameters. <br />The Seneca II-W Mine is a surface coal mine located in Routt County, approximately 9 miles south of <br />Hayden, Colorado. Coal interest is Federal, and the surface affected is Federal, state and private land. <br />The permit azea encompasses approximately 4,093.00 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman Street, Denver, <br />Colorado 80203. Persons with an interest that may be adversely affected by the proposed decision may <br />request a formal hearing before the Mined Land Reclamation Boazd on the proposed decision. Such <br />request must be made within ten (10) days of the initial publication of this notice, must be in writing, and <br />must state with reasonable specificity the reasons for the request and the objections to the proposed <br />decision. <br />
