CO 81152 ntichael B Long <br /> Orvn~on DiIPLIOr <br /> RE: San Acacio Pit (Permit M-1999-024) Withdraw) of possible violation for damage outside permit area <br /> Dear Sir: <br /> On December 16, 1999, the Division inspected the San Acacio Pit in response [o your complaint that Costilla <br /> County had encroached upon your adjacent property with their mining and reclamation activities. A[ that time, you <br /> represented yourself as the owner of the property potentially damaged by the County's activities. Acting under that <br /> belief and as a result of the inspection, the Division subsequently initiated an enforcement action against the <br /> County. <br /> On July I8, 2000, the Division received a signed and notarized affidavit from Charles Shows, the individual now <br /> recognized as the owner of record of the property in question. in his affidavit, a copy of which I have enclosed, Mr. <br /> Shows indicates that he does not believe his land to have been harmed by the County's activities and that he would <br /> have given the County permission to carry on those activities had he been asked. Further, he states that he waives <br /> any and all objection tD the mining and reclamation done by the County on his land. <br /> Under these circumstances, the Division has decided not to pursue further a possible violation by Costilla County <br /> for failure to protect the property in question from damage occurcing during mining operations and reclamation. <br /> The matter has been withdrawn by the Division from consideration by the Mined Land Reclamation Board. <br />If you have any questions on the above, please contact me. <br />Sincerely, <br />.
