The Division has <br />requested documentation, including the date, that mining operations have been reinitiated or that <br />reclamation was begun, in accordance with Section 34-32-103(13) of the Colorado Mined Land <br />Reclamation Act. <br />Operations at the Topaz Mine, Permit No. M1980055HR, were most recently conducted in 1999, not 1993 <br />as noticed in the Division letter of May 1, 2006. The following materials are attached as documentation <br />for the most recent period of operations at the Topaz Mine: <br />1. Notice of Intent to Resume Operations sent by Certified Letter, May 30, 1997, from the Operator to <br />Mr. Wallace H. Erickson at the Division's Durango, CO Office. <br />2. Notice of Intent to Continue Mining Operations, Annual Report, dated January 30, 1998. Mine re- <br />activated in July 1997. <br />3. Annual Report, dated January 26, 1999. <br />4. Annual Report, dated January 19, 2000. <br />5. Annual Report, dated January 15, 2001, stating that the Topaz Mine remains on standby-ready status <br />(actually entered temporary cessation of operations in early 1999). <br />These statements provide documentation that the Topaz Mine, Permit M1980055HR, was last active in <br />1999, not 1993 as stated by the Division.
