Box 100 e.e~~r~~eD,re<,ar <br />San Luis, CO 81152 Michael & Long <br />Divrsion Dnector <br />Re: Discussion from the May 24, 1995 Mined Land Reclamation <br />Board Meeting, and Summary of Concerns regarding <br />Compliance at the County's gravel sites (File Numbers M- <br />77-044, M-77-502, M-80-233, M-94-103). <br />Dear Board of Commissioners, <br />I brought the above-named item before the Board last week, and <br />presented some information to update them about the status of your <br />permits and files, in your behalf. The Board is still concerned <br />about the County's mining-related problems, for which you were to <br />supply a proposal at this meeting, identifying each problem and <br />explaining how each would be remedied. In particular, the problems <br />to be addressed pertained to non-compliance at the two permitted <br />sites, about the lack of any submittal of application materials for <br />the unpermitted site near Sierra Grande School, and for the <br />unfinished application for the site near San Acacio. <br />The Board shares your concern that thes problems have gone on too <br />long. However, the Board felt that, even accounting for the <br />County's hardships of turnover of personnel and non-possession of <br />your permit files, some effort by the County toward satisfying the <br />Board's required corrective actions was long overdue. The Board <br />offered you the good faith gesture of an extension of time for <br />submitting your proposal, performing site work, and submitting an <br />application. <br />This letter is to inform you that you will receive correspondence <br />soon, stating that there are several items now believed to be in <br />violation of either individual mine permits, the Rules or the <br />statutes. These items will be scheduled to be heard by the Board <br />at their July 26-27, 1995 meeting. These items include the <br />highwall instability and damage to the irrigation ditch at the Los <br />Fuertes pit; the unfinished application of the San Acacio site, <br />which should be finished or its withdrawal requested; and the <br />application for a permit at the Sierra Grande site. Should the <br />groundwater information requested for the Fort Garland landfill <br />site not be provided by the required date, that issue will be <br />noticed for the August 23-24, 1995 meeting of the Board. There may <br />
