Long <br />Division Director <br />RE: Phase III Bond Liability Release Request, Block A, Mine 2, Permit No. C-81-071 <br />Dear Mr. Mills: <br />Recently, a decision was made by the Division denying the processing of the Block A <br />Bond Release application for Mine 2, Permit No. C-81-071. Based on discussions <br />within the Division since that time, we would like to inform you that the Division <br />has decided to accept and review that application. Therefore, this reverses the <br />decision stated in our June 22, 1993 correspondence to you. <br />The reversal of this decision is for this application only; it does not apply to <br />future bond release applications. Specifically, the Division is operating under the <br />scenario outlined in the following example: <br />The operator collects data during the growing seasons of the last two years of <br />the liability period. At the earliest, this would be the summers of <br />years 9 and 10 after the last seeding or later for other parcels which have <br />had interseeding or other reclamation work after the initial seeding. ,4{,I,.Ir-1.d1 <br />Regardless, the application would be filed with the Division in the fall~of <br />the same yea the second consecutive vegetation sampling effort. Given <br />completeness requizements for bond release applications, adequacy review, and <br />probable weather complications it is likely that field inspection would not <br />occur until the following summer (June or early July). In short, the <br />application for bond release would follow the second consecutive year of <br />vegetation sampling by no more than 3-4 months. <br />Formal policy concerning final bond release process is being developed currently and <br />will be forwarded to all coal operations shortly. <br />We are currently proceeding with our adequacy review and hope to schedule a bond <br />release inspection shortly thereafter. <br />If you have other requests for bond release which have the similar situation ae <br />Block A, please contact us immediately with the specifics for each of these so they <br />can be handled appropriately. <br />if you have questions, please call me. <br />Sincerely, <br />Kent A.
