Cattany <br />Acting Division Director <br />RE: Approval and Issuance of AM-07, Hay Camp Pit Permit No. M-1990-025, and <br />request for termination of the Gardner Pit, Permit No. M-1985-172. <br />Dear Mr. Brumley and Mr. Everett: <br />On December 11, 2002, DMG approved the financial warranty for the Hay Camp Pit <br />amendment (AM-011. DMG approval process for AM-01 has been completed and the <br />conditions of AM-01 have been incorporated into the Hay Camp Pit permit. <br />Under AM-01, the permit area for the Hay Camp Pit was expanded to include all lands <br />previously permitted under the Gardner Pit permit. Reclamation of the affected lands for <br />the Gardner Pit is addressed in the newly approved reclamation plan for the Hay Camp <br />Pit. The Hay Camp Pit is issued to Four States Aggregates and the Gardner Pit is issued <br />to Montezuma County. <br />Therefore, termination of the Gardner Pit permit is appropriate because reclamation is <br />guarantied under the Hay Camp Pit permit. Should Montezuma County desire to <br />terminate the Gardner Pit permit, Montezuma County must submit a release request in <br />accordance with Construction Materials Rule 4.16.
