ti <br />Colorado Department of Public Health & Safety November 26, 2001 <br />Page 2 <br />Pond 12, which has not been in use since the mine closed in December 1999, failed due to cracks <br />forming in the bottom. Powderhorn notified Dan Mathews. Division of Minerals & Geology, <br />on Monday, November 19, and met with him at the site at 1:30 p.m at which time the discharge <br />had ceased. On November 20, as a remedial measure to prevent any precipitation from entering <br />the cracks, Powderhorn had the pond bottom in the vicinity of the cracks excavated and the <br />cracks filled. It is not anticipated that Pond 12 will be used for future purposes, therefore no <br />future dischazges aze anticipated. However, Powderhorn Coal, along with DMG, is in the process <br />implementing a plan to ensure the proper functioning or reclamation of this pond.
