ti
Colorado Department of Public Health & Safety November 26, 2001
Page 2
Pond 12, which has not been in use since the mine closed in December 1999, failed due to cracks
forming in the bottom. Powderhorn notified Dan Mathews. Division of Minerals & Geology,
on Monday, November 19, and met with him at the site at 1:30 p.m at which time the discharge
had ceased. On November 20, as a remedial measure to prevent any precipitation from entering
the cracks, Powderhorn had the pond bottom in the vicinity of the cracks excavated and the
cracks filled. It is not anticipated that Pond 12 will be used for future purposes, therefore no
future dischazges aze anticipated. However, Powderhorn Coal, along with DMG, is in the process
implementing a plan to ensure the proper functioning or reclamation of this pond. This will be
completed by December 20, 2001.
If you have any questions regazding these events, please call me at (970) 241-8118.
Sincerely,
onya and
Owner's Representative
cc: Dan Mathews
Division of Mineral & Geology
