Good Faith. <br />NOV C-93-72 <br />NOV C-93-72 deals with Colowyo's failure to suitably place and <br />protect topsoil. The topsoil in question was stored in a topsoil <br />windrow at the base of the section 16 mining area. <br />Background: Thin windrowed topsoil stockpile was added to the <br />permit during the PR-01 process. This addition was not noticed by <br />personnel in the Division until the permit revision was proposed <br />for approval. At this point some internal dialogue went on within <br />the Division as well as between Larry Routten and myself and Jim <br />Riqer o! Colowpo. The Division's concerns were that the topsoil <br />might be lost into the undisturbed area below and that runoff from <br />the undisturbed area above might collect along the topsoiled <br />windrow and erode it or reach erosive velocities along it. Colowyo <br />assured the Division that the drainage problem would be dealt with. <br />As it was by this time late Fall, it was decided that we would see <br />how the windrows (including an additional windrow constructed in <br />conjunction with the dragline movement to the Section 16 pit) fared <br />through the winter. <br />
