Just because an activity RELATES TO or <br />provides a BENEFIT to a coal mining company does not automatically make that <br />activity coal mining or reclamation. This would serve to extend the jurisdiction <br />of the Department far beyond the purpose of the Act and to impose more <br />stringent requirements on a company that engaged in coal mining. <br />3. Perhaps the most confusing aspect of this case is that Seneca did suggest, and <br />the County agreed, to reseed the area pursuant to DMG guidelines. This is <br />merely because Seneca is familiar with those requirements but it should alleviate <br />any concern that the area be properly stabilized. A copy of the permit from <br />Routt County is attached. <br />I am aware that the Department seems to have some difficulty with resolving <br />this issue in the manner that we feel is warranted. Despite any arguments about <br />fair and equitable treatment because Seneca employees did discuss the need to <br />permit this area with DMG personnel prior to the work, this issue is one that has <br />clear statutory language.
