p <br />~ R.8-c <br />RE~~~VED ~6y <br />~ JUN 2 5 2004 <br />BEFORE THE MINED LAND RECLAMATION BOARD Oiuision of Minerals & Geologq <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER REGARDING PERMIT <br />REVOCATION AND FORFEITURE OF FINANCIAL WARRANTY <br />IN THE MATTER OF LEONARD LOUKONEN, FILE NUMBER M-1986-085 ~ <br />THIS MATTER came before the Mined Land Reclamation Board ("Boazd") on May <br />26, 2004 in Denver, Colorado for a hearing to consider the request of the Division of <br />Minerals and Geology ("Division") for an order revoking a Section110c permit and <br />forfeiting the applicable financial warranty for failure to pay the annual fee and civil <br />penalties. The file number in this matter is M-1986-085. James Dupler appeared on behalf <br />of the Division. There were no appearances on behalf of Leonard Loukonen ("Permittee"). <br />The Boazd, having considered the Division's presentation and having been otherwise <br />fully informed of the facts in this matter, hereby enters the following findings of fact, <br />conclusions of law and order: <br />1. In 1986, the Boazd approved the Permittee's application for a Section 110c reclamation <br />permit fora 7.50-acre site located in Section 15, Township 6 North, Range 70 West, 6`h <br />Principal Meridian, Larimer County, Colorado. The location is referred to as the Weaver <br />Quarry site. The Permittee submitted financial warranties totaling $7,000.00 to the <br />Division to secure reclamation of the site <br />2. The Permittee failed to submit an annual report and annual fee of $281.00 to the Division <br />by December 5, 2003, in violation of Section 34-32.5-116(3), C.R.S. (2003). The Division <br />inspected the site on March 13, 2004. On February 23, 2004, the Division issued violation <br />MV-2004-013 for failure to submit an annual report and pay the annual fee. The Division <br />also assessed a civil penalty of $281.00. The Permittee submitted the annual report and <br />
