Remembering these <br />are going all the way back from 1977 to 1980. Forty days is <br />an extremely conservative figure for three pits. <br />MR. BARRY: How many of those days can you be certair <br />he was mining at his own pit and hauling from there as opposed <br />to hauling for somebody else? Any basis to say that on? <br />MR„ McARDLE: Other than the fact that he was <br />supplying the material and he's got these pits. <br />MR. BARRY: He was supplying some of the material. <br />Some of the material as he testified could not have possibly <br />come from his pit. <br />MR, McARDLE: Okay. <br />MS. BURCH: That's correct. Exhibit 1 of the <br />six items listed, only one was actually mined by Mr. Headley_ <br />The rest was either taken from the State overburden or was <br />purchased because he doesn't have crushing or washing capacity. <br />MRo BARRY: My question is what are those -- <br />MR, McARDLE: We had a letter in 1977 stating that <br />Headley was operating from, I believe, Morgan County. That <br />is one day. We have a '79 letter, an inspection that is three <br />days plus, you know, my notification in between there and <br />what the signed affidavit on the weigh receipts.
