So, you know, Mr. Headley was notified again months <br />before we went out to inspect the site. He was actively <br />mining and we did inspect it. We had complaints that he was <br />mining in between times. So, you know, again it's -- we <br />can either argue the dates or not argue them, I don't know. <br />DR. BROWN: where are we going with this permit? <br />Is there an application in? <br />MR. McARDLE: It was approved last month. We're <br />awaiting submittal of a $20,000 bond. <br />MSS BURGH: We have not yet obtained it. The <br />surety company that Mr. Headley first contacted came back <br />with a proposal that he had to put up $20,000 in cash plus <br />pay a bond fee at which point Mr. Headley said he would <br />consider another option. So we have been stymied right now. <br />We have negotiations going with two companies and we are also <br />investigating the possibility of a letter of credit or CD <br />in order to get the bond in. The other condition of approval <br />at the last meeting was county zoning approval of a special use <br />permit. There was a meeting scheduled September 2. At that <br />meeting the County Commissioners took the matter under <br />advisement.
