I don't think we have been consistent. <br />At least my memory is that we have not always taken a letter <br />from some complainant and used that as evidence that somebody <br />mined. We have generally said that we need somebody. I under <br />stand that there is some witnesses in the circumstances here, <br />but, you know, I don't want to set a pattern of saying Joe <br />Blow complains that his brother-in-law is mining gravel. <br />MR McARDLE: We don't take Joe Blow's word. We're <br />taking sworn affidavits and if we are not going to accept <br />that then, I think I could tell the Staff rather than waste <br />our time, you know, if we see them operating one day, that's <br />it because it takes an incredible amount of Lou's time, my <br />time, Shelton's time. <br />MR. BARRY: I don't question the use of affidavits <br />at all. If those letters were affidavits, that is fine. <br />MR. SHELTON: They were not from the complainant. i <br />These were the companies being supplied. So they can't grind <br />an ax. <br />MR. WOODS: This is not -- you don't have to prove <br />beyond a reasonable doubt.
