Lonp <br />D rvis ion Director <br />I have reviewed your request for vacation of Notice of Violation <br />No. C-93-008. Based upon the record, it is my understanding that the <br />Division could not locate the documents in question within the mine <br />files, but they subsequently were located by another individual. The <br />intent of the regulations ir. this regard is to insure that all <br />pertinent mine documents are readily available for public inspection. <br />I am concerned that if the Division could not locate the documents, <br />that the public would also not be able to do so. It is also unclear <br />from t?>e record where these documents were finally located, and <br />whether they were in the same file box as the rest of the mine <br />documents. Therefore, I must decline to vacate the Notice of <br />Violation at this time.
