Long , <br />Dinsion Direcbr <br />FROM: Jim Pendleton <br />RE: West Elk dequacy Review, T.R. 67 - <br />Proposed "Materials Storage Bench" <br />(Permit No: C-80-007) <br />I have reviewed the T.R. 67 application submitted by Mountain Coal <br />Company. I have also reviewed the various adequacy comments <br />prepared by Bruce Stover at your request, and the supplemental <br />submittals made by Mountain Coal Company in response to Bruce's <br />comments. Further, I toured the site with John Poulos, Project <br />Manager for Mountain Coal on Tuesday, June 21st. <br />Site Observations <br />Unlike the majority of the surface facilities area at the Mt. <br />Gunnison No. 1 mine, the proposed foundation site for the materials <br />storage bench displays no obvious evidence of recent slope <br />instability. Several of the power poles show downslope tilt, but <br />no recent slumps or landslides were detectable. The site sits <br />immediately below the ridge crest so no significant drainage <br />problems exist. I detected no ground water seeps within the <br />proposed bench footprint. _ <br />Regulatory Requirements <br />This bench is involved with underground mining, so the variance of <br />Rule 4.14.1(2)(e) does apply. Therefore, "excess material not <br />required to eliminate all highwalls and depressions need not be <br />returned to ap imate original contour as required under 4.14.2 <br />upon demonst do that the fill meets all the requirements of <br />4.05, 4.06, 4.09 nd 4.15". However, the plan submitted fails to <br />address the aimed situation. The plan will have to be amended <br />to specify t e proposed reclaimed configuration, and to demonstrate <br />that it eli inates the highwall cut during its construction. <br />/ , <br />~• S ~~1s~ <br />t}II .26155 SP°`~ ~~~ P P <br />
