<br />Conclusions of Law <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 12414) and Rule 5.03.514)(cl of the Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining, and based upon the aforementioned Findings of Fact, the Board hereby <br />concludes the following: <br />The Division appropriately issued Notices of Violations C-92-013, C-92-014, <br />C-92-020, C-92-021, C-92-028 and C-92-029 to Trinidad Basin Mining Company <br />during two inspections that occurred within atwelve-month period. <br />2. The Division and Administrator appropriately determined that a pattern of violations <br />as defined in Rule 5.03.3(2) existed at the Trinidad Basin Mine, and that the <br />violations had been caused by an unwarranted failure of the permittee to comply <br />with the requirements of the Act and Regulations. <br />3. Evidence and testimony provided by the permittee during the formal public hearing <br />did not show cause sufficient to prohibit the Board from ordering revocation of the <br />mining and reclamation permit issued to Trinidad Basin Mining Company. <br />Board Order <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by 34- <br />33-12414), and Rules 5.01.3121(a) and 5.03.5(4)(cl, the Board hereby orders the following: <br />1. Permit No. C-81-048 issued to Trinidad Basin Mining Company for the Trinidad <br />Basin Mine is revoked. <br />2. Trinidad Basin Mining Company is to immediately cease all surface coal mining <br />operations in and around the area attributed to Permit No. C-81-048. <br />In clarification of the rights of recipierits of Notices of Violation, Orders to Show Cause why <br />permits should not be suspended or revoked, and Board Orders, parties are advised to consult <br />the Colorado Surface Coal Mining Reclamation Act and the State Administrative Procedures <br />Act. <br />Persons concerned with judicial review of the provisions of this Findings Document are advised <br />to consult C.R.S. 24-4-106 as amended. <br />Dated at Denver this 7.~ day of l ~ 1993. <br />Mined Land Reclamation Board <br />Colorado Department of Natural Resources <br />~ ~~~~ <br />Maxi ~e Stewar , Chai nan <br />Mined Land Rec a ation Board <br />m:\oss\bjw\tbm <br />
