~ i <br />State of Colorado <br />Mined Land Reclamation Board <br />Department of Natural Resources <br />In the Matter of: Trinidad Basin Mining Company Permit Revocation <br />Trinidad Basin Mine <br />Permit No. C-81-048 <br />To: Trinidad Basin Mining Company and all other persons engaged in or owning or <br />controlling the following operation: Trinidad Basin Mine, Las Animas County, <br />Colorado. <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 34-3 3-1 2317), 34-3 3-1 2414), and Rules 5.03.3 and 5.03.5 of the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining, the Board convened a formal public <br />hearing regarding the February 22, 1993 issuance by the Colorado Division of Minerals and <br />Geology of an order to Trinidad Basin Mining Company to show cause why the mining and <br />reclamation permit issued to Trinidad Basin Mining Company should not be revoked. This <br />formal public hearing was held on April 22, 1993. <br />Findings of Faci <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 34-33-12317), 34-33-12414) and Rule 5.03.3(3), the Board hereby reaches the following <br />findings of fact: <br />1. The Division, pursuant to Rule 5.01.3 and 5.02.2, conducted two separate <br />inspections of the Trinidad Basin Mine. These inspections were held on <br />June 29, 1992 and July 28, 1992. <br />2. Following the June 29, 1992 inspection, the Division, pursuant to Rule 5.03.2(211a1, <br />issued on July 16, 1992 Notices of Violation Nos. C-92-013 and C-92-014. <br />NOV No. C-92-013 was issued to the permittee for its failure to maintain sediment <br />pond 15-P1 as necessary to ensure that the pond discharge met applicable <br />standards of the Colorado Water Quality Control Act and the permittee's National <br />Pollution Discharge Elimination System (NPDES) permit, pursuant to Rule 4.05.2(7), <br />4.05.2(f) and 4.05.613)la) and (b). NOV No. C-92-014 was issued to the permittee <br />for its failure to pass all disturbed area drainage through a sedimentation pond, a <br />series of sedimentation ponds or a treatment facility before leaving the permit area, <br />pursuant to Rules 4.05.2(1) and 4.05.2(2). <br />3. Following the July 28, 1992 inspection, the Division, pursuant to Rule 5.03.2(2)lal, <br />issued on August 14, 1992 Notices of Violation Nos. C-92-020 and C-92-021. <br />NOV C-92-020 was issued to the permittee for its failure to maintain sediment pond <br />15-P11 to provide adequate capacity to contain or treat the runoff or inflow <br />
