<br />4. The operator will need to flag all trees on site that have a 12" or larger DBH and flag the <br />proposed bench location. Once this flagging is complete, DMG will need to be notified so an <br />inspection can be performed to determine which trees are eligible for removal and replacement <br />at a 2 to 1 rate. Replacement trees will be required to be fenced to a height of at least five <br />feet to prevent browsing. The operator is also encouraged to plant extra trees in anticipation <br />of some mortality. If the operator wishes to remove and replace these trees at their <br />discretion, a letter from the Colorado Division of Wildlife and from the Mt. Sopris Soil <br />Conservation District agreeing to this practice should be submitted, since that commitment <br />was placed in the application at their suggestion. <br />5. Based on the revised single bench plan, the application of mulch will only be required on areas <br />where rock and soil are exposed on the final graded surface. Seeding and fertilization will be a <br />requirement on the entire disturbed area except the road to be retained and any areas where <br />more than a 1 foot layer of rock exists without soil mixed in. For reclamation cost estimate <br />purposes, it will be assumed that only one quarter of the disturbed area will require mulch, <br />however, DMG maintains that three quarters of the disturbed area will require seed and <br />fertilizer. For bond calculation purposes, please specify what length of highwall will require <br />grade reduction assuming the 1-1 /2 year contemporaneous reclamation plan proposed in your <br />last response. <br />ADDITIONAL COMMENTS <br />6. Please replace the old and new permit boundary label which was missing from the latest <br />version of application maps. <br />7. Please submit proof that the revised permit information in your adequacy responses is available <br />for public review at the County Clerk and Recorder's Office. <br />8. Please be aware that a revision to this application will be required in the future to address <br />mining in the "future mining area" if not addressed during this revision. <br />The reclamation cost estimate will be recalculated using the parameters in the original permit and <br />those changed by this revision. This estimate will be recalculated upon completion of this <br />adequacy review process.
