<br />Phase I, II, and III Hond Release application for the <br />explosives bench and its associated access road, and for <br />the portion of the haul road that is proposed for removal <br />from the permit area. This step is necessary for the <br />purpose of documenting the operator's compliance with Rules <br />3.02.3(2)(c), 4.03.1(7) (for the portion of the haul road), <br />and either 4.03.2(7) or 4.03.3(7) for the road to the <br />explosives bench. Note that Rule 4.03.3{1)(d) requires <br />light use roads to be completely removed and the land <br />affected regraded to AOC. <br />With regard to using an incidental boundary change TR <br />application in the case of Carbon Junction, that type of TR <br />would be necessary only for that acreage on the west end of <br />the permit area that was never disturbed by mining <br />operations. An incidental boundary change TR would be <br />applicable in either a case where an area was included <br />within the permit area but approved to not be disturbed, or <br />was approved to be disturbed but never was. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, <br />review or otherwise make the application for TR-04 complete. One way <br />to do this would be to separate out the explosive bench, haul road, <br />and explosive bench access road from TR-04, utilizing the processes <br />for those areas described in this letter. <br />Thank you for your participation in this matter.
