Phase I, II, and III Hond Release application for the
explosives bench and its associated access road, and for
the portion of the haul road that is proposed for removal
from the permit area. This step is necessary for the
purpose of documenting the operator's compliance with Rules
3.02.3(2)(c), 4.03.1(7) (for the portion of the haul road),
and either 4.03.2(7) or 4.03.3(7) for the road to the
explosives bench. Note that Rule 4.03.3{1)(d) requires
light use roads to be completely removed and the land
affected regraded to AOC.
With regard to using an incidental boundary change TR
application in the case of Carbon Junction, that type of TR
would be necessary only for that acreage on the west end of
the permit area that was never disturbed by mining
operations. An incidental boundary change TR would be
applicable in either a case where an area was included
within the permit area but approved to not be disturbed, or
was approved to be disturbed but never was.
In accordance with Rule 2.07.3(1), you have the opportunity to amend,
review or otherwise make the application for TR-04 complete. One way
to do this would be to separate out the explosive bench, haul road,
and explosive bench access road from TR-04, utilizing the processes
for those areas described in this letter.
Thank you for your participation in this matter. Please do not
hesitate to contact our office for any further assistance we may
provide.
Sincere ,
~CCC~Gi~<~'~Gt~~~
Daniel I.
