Banta, <br />Division Drrector <br />August 21, 1991 <br />Mr. Robert Hagen, Director <br />Albuquerque Field Office <br />Office of Surface Mining <br />Reclamation and Enforcement <br />625 Silver Avenue, S.W., Suite 310 <br />Albuquerque, New Mexico 87102 <br />Re: Grassy Gap Mine <br />Dear Mr. Hagen: <br />I would like to take this opportunity to discuss the Graisy~GaD Mine <br />inspection scheduled by the Albuquerque Field Office for August 27, 1991. <br />We have been informed that AFO and Western Support Center personnel will <br />inspect reclamation of Pits 5 and 6 in order to determine whether the <br />completed backfilling work meets AOC criteria. We are concerned about this <br />forthcoming AOC inspection in light of the backfilling stipulations of the <br />Rockcastle Compliance Agreement. <br />The Agreement at Section IV. defines AOC at Pits 5 and 6. The Agreement <br />acknowledges that there are variations between existing and proposed post <br />mining topography. However, the Agreement does not contemplate that <br />additional, large scale grading work would be undertaken. Rather, areas <br />exhibiting geomorphic or geotechnical instability will be remediated such that <br />they are stabilized. <br />The Division is concerned that revisitation of the AOC issue at Pits 5 and 6 <br />could be counterproductive to achieving the goal of site reclamation. We <br />encourage AFO to focus on assisting with the implementation of the Agreement. <br />To this end, we request that the inspection be directed to defining areas of <br />instability at Pits 5 and 6. <br />The Deputy Director of Office of Surface Mining Reclamation and Enforcement, <br />Mr. W. Hord Tipton, has found that the Agreement does not exceed the <br />Division's authority within the scope of the Colorado program. Albuquerque <br />and Western Support Center input into the implementation of the Agreement <br />would serve all parties well. <br />
