III. COMMENTS -COMPLIANCE -- <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />The operator has mazked the boundary of the upper azea proposed for bond release from <br />the lower azea with white pvc pipes on poles. Field examination suggested that the <br />boundary should be moved upgradient in the northern section so that there is sufficient <br />-room to place the soil that will need to be removed from the East Roatcap Creek area. <br />The reclamation of the haul read that leads from the public road to the West Mine portal <br />bench was inspected. The backfilling of this road resulted in a somewhat concave cross- <br />section, which provides a break in the slope. <br />During the field inspection, BLM expressed a concern about a scarp on the constructed <br />sheep trail. This scarp is visible from the public road. BLM and BRL will continue to <br />work on this issue. <br />West Mine -Fan Area <br />After the field inspection of the West Mine portal bench was finished, the inspection <br />moved to the West Mine fan site. At this site, BRL requested bond release for structural <br />demolition of the vent fan and wood shack superstructures, for removal of two <br />transformers and for the sealing of the vent shaft. Only the 200,000 gallon water tank <br />with its concrete pad remain at this site. The rest of the demolished facilities were <br />removed and salvaged. The concrete footings and slabs were, used as fill for the vent <br />shaft. The operator has not made a decision yet on whether or not they want the water <br />tank to remain. If the water tank is to remain, the Division will need a letter from BLM <br />agreeing to this and an explanation of how the water tank would help support the post- <br />mining land use. <br />The vent shaft has been filled with 75 feet ofnon-combustible material, followed by coal <br />refuse and rock and, then, topped with soil. Although there was settling of fill material <br />initially, the settling appeazs to have stopped. As of the date of this inspection, the <br />concrete seal has not been built over the top of the filled invent shag. However, BRL <br />will attempt to finish the shaft sealing before the next bond release inspection in July. <br />Sediment control at the West Mine fan site consists of a silt fence for the fan site and <br />vegetative cover for the topsoil stockpile. The silt fence was in good condition and there <br />was an excellent vegetative cover on the topsoil stockpile. There were no signs of <br />erosional gullying at this site. <br />
