III. COMMENTS -COMPLIANCE <br />Below are comments on the Inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the Inspection <br />and the facts or evidence supporting the erforcement action. <br />Mine portal bench azea, BRL requested bond release for complete structural demolition, . <br />mine portal sealing and baclcfilling and grading of a portion of the azea. At the West Mine <br />fan area, BRL requested bond release for limited structural demolition work and for the <br />sealing of the vent shaft. At the East Mine, BRL requested bond release for limited <br />structural demolition at the facilities azea, for disposal of the coal waste at the temporary <br />coal waste stockpile and for work done at the West Ridge waste pile. BRL also requested <br />bond release for the removal of coal waste at the run-of--mine (ROM) stockpile and for <br />removal of coal at the highway temporary coal stockpile. <br />This was the second attempt at inspecting this mine site for bond release. The first <br />attempt occurred on December 17, 2002 and was called off due to a significant snowfall <br />at the mine site. As of the time of this inspection, BRL has not submitted responses to the <br />Division's adequacy review letter dated 7anuary 6, 2003. <br />The Bowie No. I Mine is classified as a federal mine. Representing the federal. <br />government during the entire inspection was Randy Pair of the Office of Surface Mining. <br />Also present for the entire inspection was Basil Beaz, representing the operator, BRL. <br />Collin Stewart represented BRL as well during the start of the inspection. The land <br />manager for the West Mine azea and for the West Ridge Waste Pile at the East Mine is <br />the Bureau of Land Management (BLM). Representing the BLM was Desty Dyer and <br />Danna Knox. The surface owner of the azea undergoing bond release at the East Mine, <br />Kenneth Pavlisiclr, was present for that portion of the bond release inspection. <br />Included in this inspection and evaluation report is a listing of the reclamation items at <br />the Bowie No. 1 Mine and notations on whether the reclamation bond for that item can be <br />released at this time. This list is based on the Division's reclamation cost estimate form. <br />West Mine <br />The West Mine was constructed in 1986 when a mine fire closed the main portals at the <br />East Mine. The,mine site is accessed by way of an upgraded and widened public road that <br />leads from the Stevens Gulch road into the East Roatcap Creek watershed. The West <br />Mine consists of two azeas; the West Mine portal bench and the West Mine fan site. The <br />West Mine portal bench was accessed over a haul road that came off of the public road. A <br />light use road accessed the West Mine fan site from the same public road. A second light <br />use road connects the West Mine fan site with the West Mine portal bench azea. <br />2 <br />
