Morrison, Reclamation Specialist <br />Colorado Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Subject: Permit revision for Pittsburg & Midway Coal Mining Company's, Edna <br />Mine, Oak Creek, Routt County, Colorado (File No. C-80-001) <br />(PR-03) <br />Ms. Morrison: <br />The Pittsburg & Midway (P&M) Coal Mining Company wishes to leave two of its <br />sedimentation ponds as permanent structures after termination of mining <br />activities and declassify the Oak Creek flood plain from an "alluvial valley <br />floor". Declassification would mean that the valley floor would not be <br />classified as cropland and; therefore, P&M would not have to be held <br />accountable for coal mine effluent impacts to the valley. <br />The Fish and Wildlife Service (Service) will not object to leaving the ponds <br />if native wetland vegetation is seeded around the shoreline and 75Y growing <br />success is achieved within the timeframe of the reclamation bond. This <br />measure may prevent leaving a barren watering hole and help wildlife <br />associated with wetland areas. The vegetation may also help retain <br />contaminants and provide better water quality for consumptive use by animals. <br />The Service does not think declassification from "alluvial valley floor" <br />should be allowed.
